Glossy spreads in leading business magazines & newspapers and tall claims about state-of-the-art infrastructure, world-class placements are some of the selling points used by the infamous Amity Business School, Noida. Amity had used the ‘thought leadership’ plank to gain respect among the student community. It had regular columns in magazines like Business Today. Amity also conducted online quizzes in partnership with Business World. Being a big advertiser in these magazines worked out to Amity’s advantage as it was successful in ‘buying’ the rankings in the annual B-School survey. The AICTE has finally woken up to all these false claims and has decided to withdraw the approval for some of the courses offered by Amity.
Few months ago, Rashmi Bansal had mentioned that the owner of Amity Business School was wanted by Interpol for financial frauds committed in Germany.

However, Amity’s website sings a different tune:

Amity has been setup by the vision of Dr. Ashok K. Chauhan Chairman of the worldwide AKC Group of Companies who went to Germany over four decades ago and established a great business empire and became one of the greatest NRI’s of Europe. It is his commitment to his country and his believe that India will be world's superpower by 2030 that he established the Amity institutions.

The Telegraph has more on the latest developments:

“Amity Business School was found to conduct a large number of unapproved courses on the same premises, some even in collaboration with foreign universities that require the council’s mandatory sanction,” the technical education council said in a press statement.

The list of complaints against Amity is substantive. “Their admission procedure was not transparent. The institute was involved in commercialisation of education and charged exorbitant fees,” said the council.

The Amity Business School charges Rs 4.1 lakh for two years from non-sponsored students and Rs 6.2 lakh from company-sponsored students. The institution claims that it invests the money in infrastructure.

High Court orders closure of Amity Business School
Honb'le Allahabad High Court had dismissed the petition filed by Amity against AICTE for derecognising courses of Amity Business School. High Court in its judgement clearly stated than every institute which is not adhering AICTE norms will be close down from MARCH 7, 2006.

It is to be recalled that AICTE had derecognised Amity Business School and flagship course of Amity last year 2005 on three counts :

1. Post Graduate Courses are being run at same building where MBA courses are running and it is observed that classes are being held at the basement of the building.
2. Fees charged is very high against AICTE recommendation.
3. No separate infrastructure, library etc for PG diploma in Management courses.
4. Illegal foreign tieups with PGDM courses.

Amity went to the High Court against the AICTE decision to withdraw recognistion.

Allahabad High Court decision is produced below alongwith the press release issued by AICTE withdrawing and closure of Amity Business School :

Extract of the Judgment of Hon’ble Allahabad High Court in Civil Misc Petition No. 65741/2005 filed by Amity Business School V/s AICTE and Others regarding withdrawal of approval

“The impugned order in question reflects that the reply which was submitted by the
petitioners has been considered and it has been found that courses approved by the All
India Council for Technical Education are being conducted in gross violation of the norms
and standard prescribed by the All India Council for Technical Education, and further the
Amity Business School is conducting large number of unapproved courses in the same
premises utilizing the infrastructure, faculty and other facilities intended for by the
AICTE approved courses, and thus, diluting the standard of education. Thus, in the
present case, reply has been considered though not very elaborately, but the finding has
been returned that large number of unapproved courses are being run in the same
premises utilizing the infrastructure, faculty and other facilities intended for the AICTE
approved courses, and thus, diluting the standard of education. Original record has also
been produced, and it reveals that representative of the petitioner has admitted that large
number of unapproved courses are being run in the same campus. Smt. Balwinder
Shukla, who is the Deputy Director General, Amity Business School, Noida, on 05-08-2005
has certified that report which has been prepared, is based on factual information
furnished by Institution and cross checked by the Committee through physical
inspection. In column No. 10 of the Institutional Details, the question posed is whether
the institution is sharing its facilities/premises with any other institution or running any
unapproved programme and the same has been ticked as “yes” and coupled with this
name of institution which is sharing the facility, has also been disclosed as (1) Amity
University Raipur (2) Amity University UP (3) Centre for International Business (4) Centre
for CRM and Marketing (5) Centre for E & S. At the point of time when approval had
been accorded in the year 1994, there was specific condition that no other courses would
be run without the permission of the AICTE. Here, the other courses are being run in the
same premises, which are unapproved without taking permission from the AICTE, and
this fact has been admitted by the petitioners, and if this is not in dispute that in the same
campus unapproved courses are being run, and the Expert Committee, on the basis of the
same has concluded that standard of education is being diluted, then same cannot be
termed to be arbitrary exercise of authority. One of the reasons mentioned in the
impugned order is that the same premises is being used for running unapproved courses
utilizing the same infrastructure, and thus diluting the standard of education. Thus, this
reason in itself is enough to justify the action taken by the AICTE. Apart from this record
in question reveals that after reply was submitted by the petitioner comparative chart
dated 02-09-2005 has been prepared, containing three column. In the first column the
deficiencies communicated have been taken note of. In the Second column, reply qua the
same submitted by the petitioner has been taken note of. In the third column,
conclusions/observations qua the same have been mentioned, indicating brief reasons
why petitioner’s claim is not being accepted. On the basis of the same and other records
decision has been taken, which has been duly ratified by EC Sub-Committee vide
Resolution No. 4 in meeting dated 16-9-2005, and thereafter communication dated 17-9-
2005 has been sent, containing brief reasons for conclusions arrived at. Much emphasis
has been laid by the petitioners on the fact that report was not given, as such principles of
natural justice was violated Grievance of the petitioners has to be decided in the light of
the provisions of Section 11 of the AICTE Act, 1987. There is no obligation cast upon the
Council to supply copy of the inspection report, rather to the contrary obligation is that
the Council shall communicate to the technical institution its views in regard to result of
any such inspection, and here gist of the report has been mentioned in the show cause
notice and the same was replied by the petitioner and the said reply did not find favour,
as such it is incorrect to suggest that cause of the petitioner was in any way prejudiced on
account of non-supply of copy of inspection report, which had been prepared on the basis
of material supplied by petitioner themselves and qua which certification has been made
by Dr. Balwinder Shukla that same is based on information furnished by Institution and
cross checked by Committee by physical inspection. Thus, in the fact of present case
natural justice has been complied with, reasons are there in the record and brief reasons
have been indicated in the impugned order.”
“ Hon’ble Apex Court in the case of IITT College of Engineering vs. State of H.P. 2003 (7)
SCC 73 has taken the view that it is open to the AICTE/University Authorities to call upon
the petitioner to remedy the deficiencies that may be persisting at the time of granting
affiliation/approval in the future and in case of noncompliance, to take such action as is
open to them under law. Two courses were open to AICTE i.e. either to direct the
petitioner to remove deficiencies or in the alternative withdraw affiliation. AICTE in its
wisdom had chosen to withdraw recognition, as such its action being well within its
bound, is not being interfered with. However, in the facts of the present case, as
recognition is limited only up to academic session 2005-06, and students are already
pursuing their course on the strength of interim order passed by this Court, liberty is given
to petitioner to represent the matter before AICTE after removing all the deficiencies, and it
would be open to AICTE to take appropriate decision on the same, if it is satisfied that
deficiencies mentioned have been removed, in accordance with law. This liberty does not
entitle the petitioner to run the course.
Subject to observations made above, present writ petition is dismissed.

PRESS RELEASE
WITHDRAWAL OF APPROVAL TO AMITY BUSINESS SCHOOL, NOIDA

All India Council for Technical Education (AICTE) in exercise of its mandate to
ensure maintenance of norms and standards to insist on fulfilment of the
minimum requirements prescribed for imparting technical education by
institutions, so that quality of courses is not compromised, has been conducting
Annual inspection and surprise inspection under Section 10(p) of AICTE Act.
Experts drawn from premier institutions participate in this exercise to identify
violations of norms and standards. It conveys the deficiencies to the institutions
for rectification. In spite of repeated advice to comply with minimum norms and
standards, many institutions continue to be complacent about taking steps to
remedy the deficiencies. This has evoked grave concern amongst all the stake
holders.
As part of the exercise, Expert Committees of AICTE have visited Amity
Business School at Noida on several occasions during the last few years and
show cause notices have been issued for violating norms and standards set by
the Council. Expert Committees visited Amity Business School, Noida recently
on 27th July 2005 and 5th August 2005 have since found serious deficiencies and
violation of Norms and Standards. Amity Business School was also found to
conduct large number of unapproved courses in the same premises (some even
in collaboration with foreign universities which require mandatory approval
from the AICTE) utilising the facilities and infrastructure intended for AICTE
approved courses, thus diluting the standards of education. As it is, the Institute
has violated building laws and also lacks requisite built-up area as per AICTE
norms. It was also found that the admission process followed by the Institute
was not transparent and is involved in commercialisation of education by
charging exorbitant fee from students. As Amity Business School contravened
the conditions of approval, AICTE decide to withdraw approval for conduct of
PGDM (FT) and PGDM (PT) courses from the academic year 2005-06.
Consequent upon withdrawal of AICTE approval, the Council decided to
transfer and distribute the students already admitted in Amity Business
School, Noida among other approved institutions in the nearby locality. September 17, 2005 VICE-CHAIRMAN.

Amity University Fraud!

This series will attempt to expose the hollow and shallow claims made by many private educational engineering institutions in India. We start off with Amity University.
The owner of Amity Group is Ashok Kumar Chauhan. He is wanted by the Interpol in connection with frauds he comminted in Germany.
Apparently this man has got the backing of top politicians in our country who send their sons and daughters to these institutions. Getting admission into these private colleges is extremely simple if you have got the green stuff with you. The reason why this story failed to make it to the national newspapers can be explained by the fact that Amity is an important advertiser in the Media. However Tehelka crried out this story and Amity tried their best to prevent this story from going to print.
"First the Chauhans tried to stop the story through subtle offers of advertisement support. Thet made several phone calls and sent several Amity representatives to Tehelka saying they would like to keep copies of Tehelka on their campuses. That having failed, they offered to bear the costs of stopping the printing press. When even this did not work, they tried to buy as many copies at traffic signals and from distributors.

Deepak Sehgal, proprietor of Central News Agency (CNA) which supplies the newspaper to retailers stated that demand for the Jun 11 issue suddenly shot up in the market."

This shows that all people in our country are equal but some people are more equal than others! Do not fall for the hollow promises of these institutions. What they advertize may be far from truth. Make an informed decision.
